Odor of Marijuana Smoke Not Legally Offensive, Oregon Appeals Court Rules

In an opinion of first impression, the Oregon Court of Appeals ruled that the odor of marijuana wafting from a neighbor’s apartment is not legally “offensive” and does not justify a search warrant under Oregon law.

With cannabis law reform sweeping the nation, the issue of whether smoking at home is offensive to neighbors is likely to become an issue.  In DC, marijuana can only be legally smoked at home. The potential disturbance to neighbors and the presense of children at home is one reason that DC activists are pushing for the legal consumption of cannabis in public places, such as clubs or bars.
